Agreement to Terms

Welcome to Kaliero. These Terms of Service ("Terms") govern your access to and use of the Kaliero mobile application and website (collectively, the "Service"), operated by Kaliero ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Eligibility

You must be at least 13 years old to use Kaliero. By using our Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into a binding agreement
  • You are not prohibited from using the Service under applicable laws
  • If you are under 18, you have obtained parental or guardian consent

Your Account

Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Account Security

You are responsible for safeguarding your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

Acceptable Use

You agree to use Kaliero only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any person or entity, or falsely state your affiliation
  • Harass, bully, stalk, or intimidate other users
  • Share false or misleading information about parks or locations
  • Spam, advertise, or solicit without authorization
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated means (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble the app

We reserve the right to remove content and suspend or terminate accounts that violate these rules.

User-Generated Content

Your Content

You retain ownership of content you create and share on Kaliero, including:

  • Profile information and photos
  • Workout session notes and ratings
  • Posts, comments, and messages
  • Park suggestions and reviews
  • Event descriptions

License to Us

By posting content on Kaliero, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute your content in connection with operating and improving the Service. This license ends when you delete your content or account.

Content Responsibility

You are solely responsible for the content you post. We do not endorse user content and are not liable for any content posted by users. We may remove content that violates these Terms or applicable laws.

Park Information

Kaliero provides information about calisthenics parks sourced from:

  • OpenStreetMap: Community-sourced geographic data
  • User contributions: Parks suggested by our community

We strive for accuracy but cannot guarantee that all park information is current or correct. Parks may have changed, closed, or have different facilities than listed. Always verify park conditions before visiting.

Safety Notice: Exercise at your own risk. We are not responsible for injuries, accidents, or other incidents that occur at any park. Always inspect equipment before use and exercise within your abilities.

Groups & Events

Users can create and join groups and events on Kaliero. When participating in groups or events:

  • Group owners and admins are responsible for moderating their groups
  • Event organizers are responsible for the accuracy of event details
  • We are not responsible for actions taken by group members or event attendees
  • Participation in real-world meetups is at your own risk

Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Kaliero and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without our prior written consent. Nothing in these Terms grants you any right to use our branding.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Kaliero, you agree to our Privacy Policy.

Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or content that are not owned or controlled by us. We are not responsible for:

  • The content or practices of third-party services
  • Data handling by third parties (Google, Apple for OAuth)
  • External links shared by users

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and data
  • Provisions that should survive termination (e.g., limitation of liability) will remain in effect

You may delete your account at any time through Settings > Delete Account.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
  • That the Service will be uninterrupted, secure, or error-free
  • That park information, user content, or other data is accurate, complete, or current
  • That defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALIERO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Personal injury or property damage resulting from your use of the Service
  • Any unauthorized access to or use of our servers or your personal information
  • Any conduct or content of third parties on the Service

In no event shall our total liability exceed the amount you paid us in the past twelve months, or $100 USD if you have not made any payments.

Indemnification

You agree to defend, indemnify, and hold harmless Kaliero and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your content, or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Sweden.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Updating the "Last updated" date at the top
  • Sending a notification through the app or email for significant changes

Continued use of the Service after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
